Product Claims and Return Policy for Goods from China

1. General Claims Policy Due to the international nature of this business-to-business (B2B) transaction, all sales are considered final unless a claim is made for defective or non-conforming goods in accordance with this policy. The Buyer assumes all responsibility for complying with their local import regulations, customs, and taxes.

2. Notification of Defects or Non-Conformity The Buyer must inspect all goods immediately upon receipt. Any claim for damaged, defective, or non-conforming products must be submitted to the Seller in writing within seven (7) business days of the delivery date. The claim must include the following documentation:

  • Detailed description of the defect or non-conformity.

  • Clear photographic or video evidence of the issue.

  • The original order number and invoice details.

  • A copy of the shipping documents (Bill of Lading or Air Waybill).

3. Acceptance and Evaluation of Claim Upon receiving a complete claim, the Seller will evaluate the evidence and determine, at its sole discretion, if the goods are indeed defective or non-conforming.

  • The Seller reserves the right to request a third-party inspection of the goods at the Buyer's location, at the Seller’s expense, to verify the claim.

  • The Seller may also require the Buyer to return a sample of the defective products for a quality control assessment.

4. Remedy for Valid Claims If the Seller accepts the claim, one of the following remedies will be offered, at the Seller’s sole discretion:

  • Replacement: The Seller will produce and ship replacement products for the defective quantity. The Buyer will be responsible for shipping costs and any associated import fees.

  • Credit: The Seller will issue a credit note for the value of the defective goods, which can be applied to a future order.

  • Refund: The Seller may, in exceptional circumstances, offer a partial or full refund for the value of the defective goods.

5. Limitation of Liability The Seller’s liability for defective or non-conforming goods is strictly limited to the value of the goods in question. The Seller shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, loss of business, or costs incurred for inspection or customer returns. The Buyer acknowledges the inherent risks of international trade and agrees to budget for a reasonable percentage of defective products.

6. Return of Goods In cases where the return of goods is required or agreed upon, the Buyer is responsible for all costs and risks associated with shipping the goods back to the Seller's designated facility in China. The Seller will not be responsible for any customs duties, taxes, or fees incurred during the return shipment. Any refunds or credits will only be processed after the Seller has received and inspected the returned goods.

7. Governing Law and Dispute Resolution This policy is governed by the laws of [Insert Your State/Country, e.g., the State of California, USA]. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts located in [Insert Jurisdiction, e.g., Los Angeles County, California].
